These Terms are an agreement between you and the operator of EduQuiz about using the website and the Pro membership plans. They are made under Vietnam's Civil Code, the Law on Consumer Rights Protection, and Vietnamese law on e-commerce, cybersecurity and personal data protection.

By creating an account or using the service, you confirm that you have read, understood and agreed to these Terms and the Privacy Policy. If you do not agree, please do not use the service.

This is a translation. If it differs from the Vietnamese version, the Vietnamese version prevails.

1. Service provider

EduQuiz is owned and operated by an individual (an independent developer). It is not a company's service. In these Terms, "we" means that individual.

Their full name, personal tax code and contact address are shown in the Owner information box above and in the site footer. Contact email: teamdevdesignwebsite@gmail.com.

2. The service

EduQuiz is an online learning platform with:

• multiple-choice tests and exercises, with scoring and explanations;
• TOEIC practice;
• a document library;
• leaderboards and achievement badges;
• a blog;
• an AI study assistant.

Some content is free. Content marked Pro requires an active Pro membership.

3. Accounts

1. Your information must be accurate. Each person may use only one account, and you must not register with someone else's details.
2. Users under 16 may only register with the consent of a parent or legal guardian, who is responsible for supervising the child's use.
3. You keep your password secret and are responsible for activity on your account.
4. Tell us immediately if your account is accessed without permission.
5. Do not share, lend, rent or resell accounts, including Pro accounts.

4. Prohibited conduct

When using the service, you must not:

1. post or send content that breaches Article 8 of the Law on Cybersecurity or related laws. Examples: content against the State, distorting history, inciting violence, obscene content, insulting others' honour or dignity, false information;
2. copy, bulk-download, distribute or resell tests, explanations or documents (especially Pro content) without our written permission;
3. use automated tools (bots, scripts, crawlers) to scrape data, take tests for others, or cheat scores or rankings;
4. try to bypass Pro content restrictions, probe for vulnerabilities, attack the system, spread malware or overload the service;
5. impersonate others, harass, or spam in comments or the AI Assistant.

Violations may lead to content removal, account suspension (section 10), and action under the law.

5. Intellectual property and user content

1. Our content: tests, explanations, documents, interface, logo and source code of EduQuiz belong to us or to parties who licensed them to us. You may use them for personal, non-commercial study.
2. Content you post (comments, avatar…):
   • you keep your rights to it;
   • you allow us to store and display it on EduQuiz to run the service;
   • you warrant that you have the right to post it.
3. We may remove content that breaches these Terms or the law without prior notice.
4. If you believe content on EduQuiz infringes your rights, send a notice with evidence to teamdevdesignwebsite@gmail.com. We will review and handle it promptly.

6. AI Assistant

• AI Assistant answers are generated by an artificial intelligence model. They are for reference only and may be inaccurate.
• The AI Assistant does not replace teachers or official materials. Check answers yourself before relying on them.
• Do not enter sensitive information into the AI Assistant. See sections 5 and 6 of the Privacy Policy.

7. Pro membership: general terms of sale

1. Plan information: plan name, duration, benefits and price are listed on the Pro plans page.
   • Prices are in Vietnamese dong and include all applicable taxes (if any).
   • There are no other fees.
2. How to order:
   1. choose a plan and send a request through the Contact page;
   2. we send you the payment details (bank transfer);
   3. you pay, using the correct transfer note;
   4. we confirm and activate Pro on your account email, normally within 24 business hours.
3. Contract formation: the contract is formed when we confirm receipt of payment and activate the plan. The activation notice (on the website or by email) is the transaction confirmation.
4. Duration:
   • starts at activation;
   • buying again while a plan is active extends it consecutively, with no days lost.
5. No automatic renewal: when a plan expires, the account returns to free and nothing is charged. To continue, you order again yourself.
6. Scope of use: a Pro plan belongs to one account and one user only. Breaching section 3.5 or 4 may end the plan under section 10.

8. Refund policy

1. Full refund of the amount paid when:
   • you paid but we could not activate the plan within 3 business days, through no fault of yours;
   • you paid twice or overpaid;
   • you ask within 3 days of activation and have not used any Pro content (no Pro tests taken, no Pro documents read or downloaded).
2. Pro-rata refund for the remaining time when Pro is unavailable for more than 72 consecutive hours through our fault, or when we discontinue the service (section 9.2). You may choose extra days instead of money.
3. No refund when:
   • Pro content has been used, except under point 2;
   • more than 3 days have passed since activation, except under point 2;
   • the account was terminated for breaching section 3.5 or 4.
4. How to request: email teamdevdesignwebsite@gmail.com from your account email, with the transaction reference or screenshot and the reason. We reply within 3 business days.
5. Refund timing: once accepted, the money is refunded to the account you paid from within 7 business days. The related Pro plan is then cancelled.
6. This policy does not limit any consumer rights provided by law.

9. Changes and suspension of the service

1. We may maintain, upgrade or change features. For planned maintenance, we try to give notice on the website.
2. If we discontinue the service entirely, we give at least 30 days' notice and refund the remaining Pro time under section 8.2.

10. Suspension and termination

1. You may stop using the service and ask us to delete your account at any time, under section 8 of the Privacy Policy.
2. We may suspend or terminate an account that breaches section 3 or 4, or at the request of a competent authority.
   • Except in emergencies or serious violations, we will give the reason and a chance to explain.
3. Accounts terminated for violations are not refunded for remaining Pro time.

11. Limitation of liability

1. We work to keep tests and explanations accurate and the service stable, but we do not guarantee any particular exam result. Results depend on your own study.
2. We are not liable for damage caused by:
   • your own fault (leaked password, wrong information);
   • force majeure;
   • failures of network or infrastructure providers beyond our reasonable control.
3. These Terms do not exclude our liability where the law does not allow it, in particular under the Law on Consumer Rights Protection.

12. Complaints and disputes

1. Send complaints to teamdevdesignwebsite@gmail.com or through the Contact page.
   • We acknowledge within 3 business days and resolve within 15 days of receiving complete information.
   • Complex cases may take longer; we will tell you if so.
2. Both sides will first try to negotiate. If that fails, you may:
   • ask for mediation;
   • contact a consumer protection authority or organisation;
   • bring the case before a competent court of Vietnam.
3. These Terms are governed by the laws of Vietnam.

13. Amendments

We may amend these Terms and will announce the changes on the website before they apply.

• If a change is unfavourable to you regarding a Pro plan you already bought, the old terms keep applying to that plan until it expires.
• Continuing to use the service after the effective date means you accept the amendment.

14. Language and contact

These Terms exist in Vietnamese and English. If they differ, the Vietnamese version prevails.
